Immigration and Customs Enforcement (ICE) officers in Boston are raising serious concerns about the release of illegal immigrant offenders who have been charged with violent crimes, including child sexual offenses. These offenders are reportedly being released on bail amounts that many consider shockingly low, allowing them to return to the streets despite their serious charges.
A recent investigation by CBS Boston, highlighted by Fox News reporter Bill Melugin, confirmed that some individuals charged with heinous crimes, such as child rape, are being let go with minimal bail. For example, a Guatemalan man facing three counts of aggravated child rape was released on just $7,500 bail, while another charged with the same crime involving a victim aged nine or younger was also released on the same amount. Additionally, a Honduran man charged with assault to rape and armed robbery was released on his own recognizance with zero bail. In Worcester County, two illegal immigrants charged with child rape received bail set at only $500 each. Another case involved a person charged with fentanyl trafficking who was released on a $4,000 bond before ICE could intervene.
Tom Homan, a prominent figure in immigration enforcement, addressed these issues during the Conservative Political Action Conference. He criticized Boston’s police leadership for allowing such releases, urging Boston Police Commissioner Michael Cox to reconsider his role in light of these serious public safety concerns. Homan pointed out that local authorities are releasing offenders despite ICE detainers, which request cooperation with federal immigration enforcement.
The situation is complicated by Massachusetts state laws that restrict the detention of illegal immigrants based solely on their immigration status. A ruling from the Massachusetts Supreme Judicial Court in 2017 reinforced this by stating that individuals cannot be held after posting bail, even if there is an ICE detainer in place. This legal framework has created a challenging environment for ICE and local law enforcement, leading to frustrations over the perceived lack of accountability in handling serious criminal cases involving illegal immigrants.
