Proposal Seeks to Circumvent Impeachment and Oust Judge Who Halted Trumps Deportation Flights

A new proposal from House Republicans aims to remove Judge James Boasberg, who was appointed by former President Obama. This move comes after Boasberg blocked President Trump’s administration from deporting suspected Venezuelan gang members under the Alien Enemies Act.

Rep. Andy Biggs from Arizona introduced a resolution on Monday, arguing that Boasberg has failed to uphold the standard of good behavior required by the Constitution. Biggs stated that the judge has abused his authority for political reasons and should not remain in his position. He emphasized that Congress has a responsibility to support the President’s ability to enforce laws.

Biggs is also a co-sponsor of impeachment resolutions against Boasberg but recognizes that these efforts are unlikely to succeed due to the need for a two-thirds majority vote in the Senate, where Republicans hold a narrow majority. Instead, Biggs believes his resolution can pass with a simple majority, as it claims that judges can be removed in the same way they are confirmed.

Some members of the Republican party, along with Trump, have called for Boasberg’s impeachment. The judge has been involved in high-profile cases, including those related to the Russiagate investigation and other legal challenges against the Trump administration.

In response to these calls, Chief Justice John Roberts issued a statement reinforcing that there is a standard process for appealing judicial decisions. Meanwhile, House GOP leadership is moving forward with hearings and legislation. This week, the House is expected to vote on a bill aimed at limiting federal judges from issuing nationwide injunctions against the Trump administration.

Biggs expressed concern about judges who, in his view, overstep their authority and impose their political views on the public. He argues that such actions undermine the elected President’s power and the rule of law.
